Florida man kicked off jury for Facebook friend request

SARASOTA, Florida ? A Florida man has been removed from a civil trial jury after sending a Facebook friend request to one of the defendants.

The Sarasota Herald-Tribune reports Jacob Jock arrived for jury duty Dec. 12. He was placed in a jury pool for a personal injury lawsuit from a traffic accident case. That's when he used his phone to access Facebook and see whether he knew anyone involved.

Jock says he accidentally sent a friend request to one of the defendants, Violetta Milerman.

He was selected to serve on the jury, and Milerman informed her attorney about the friend request the next day. Jock was dismissed.


Senior Circuit Judge Nancy Donnellan admonished him for violating her instructions on not to discuss the case or use the Internet to find information.

Lindsay Lohan Threatens Legal Action Over Dubai Party Reports ...

Lindsay LohanLindsay Lohan is threatening to take legal action against a party planning company over allegations her name has been used to promote a New Year's Eve bash in Dubai.

Lohan's representatives are to send a cease and desist letter to the unnamed firm to clear up false reports suggesting she will ring in 2012 at a massive party on a cruise ship in the United Arab Emirates, according to TMZ.com.

The actress' spokesman Steve Honig is adamant the story is untrue as Lohan plans to ring in the new year in California.

He tells the website, "Lindsay is not going to Dubai, nor had she ever considered doing so. She will be spending New Year's Eve in Los Angeles with a few close friends and family."

Developers Outsmart Apple Get "Lock Screen Weather App" Into App Store

Displaying information on iOS?s lock screen is old hat for jailbreakers, but Apple appears to have approved an App that brings weather information to the lock screen of non-jailbroken devices.

Apple normally doesn?t allow applications, even their own, to display information on the lock screen. Apple?s own weather widget in the notification center can?t even display information on the lock screen. How ?Lock Screen Weather App? pulled a fast one on Apple is actually quite simple.

The app actually plays a silent song through the built-in iPod app and then displays the album art in the lock screen. However, the album displays the weather forecast based on your location and comes complete with a five-day outlook. The workaround manages to side step Apple?s rules regarding the lock screen and how apps interact with other programs.

Sadly if the this app is activated no other audio can be output through the device?s headphone jack. So users must weigh their need to know the weather against their love of music as both aren?t mutually inclusive. Also, because the music player is constantly "playing", even if that playing is inaudible, battery life might take a hit.

Lock Screen Weather App is currently available in the App Store for $.99, but knowing Apple they could rewrite the rules and pull the app before the weekend is out. Then again, Apple did approve an app titled ?Lock Screen Weather App.?

Foul play suspected in Maine girl's disappearance

Police investigating the disappearance of a 20-month-old girl from her father's home two weeks ago said Friday they believe foul play was involved.

Waterville police Chief Joseph Massey announced Friday night the case "has evolved from the search for a missing child to a criminal investigation." In a statement, he said the conclusion was based on evidence gathered over the past two weeks. He didn't elaborate.

Ayla Reynolds was last seen on Dec. 16. Her father, Justin DiPietro, told police he put her to bed that night in his Waterville home. He reported her missing the following morning.

Police previously said they believed someone had taken the girl from the home. Police have received hundreds of tips as they've searched for her.

Ayla was wearing green pajamas with polka dots and the words "Daddy's Princess" on them and had a soft cast on her broken left arm. Extensive searches of woods, waterways, fields and private properties around Waterville, a city of 16,000 residents 20 miles north of Augusta, have failed to turn up anything.

Earlier Friday, police said DiPietro and Ayla's mother, Trista Reynolds, of Portland, were cooperating with investigators.

Investigators put up crime scene tape at the father's home last week, and two of the state's top homicide prosecutors were called in to get a look at the site. WABI-TV reported that a state police forensic team was back at the home on Friday.

Ayla was placed in her father's care while her mother was in a substance abuse rehabilitation program, which she has finished.

Trista Reynolds, making an appeal on national television on Thursday, said DiPietro has not returned her calls since their daughter went missing, and she asked him to reach out. On Friday, she had no further comment, her sister said.

DiPietro, addressing the public for the first time early last week, said in a statement he had "no idea what happened to Ayla or who is responsible." He said his family and friends would do "everything we can to assist in this investigation and get Ayla back home."

Former FBI profiler Clint Van Zandt said the odds of finding a child lessen if he or she isn't found within the first day or two of disappearing. But he said there's some reason for optimism because there are rare cases of missing children who turn up years later in someone's care.

"If you don't get this child back real quickly, you know that it gets harder and harder," he said. "But you can't give up hope."

Scott Bernstein, founder of Child Recovery International, a New York City-based organization that helps find missing children, agreed the first hours of an investigation are key in tracking down missing children as young as Ayla. Although the situation looks bleak, there's still room for hope, he said.

"One percent hope ? but I'll go for that 1 percent hope," he said.

After Ayla went missing, law enforcement officials likely divided their investigation into two parts, one team looking at people with access to her, such as relatives and family friends, and another group looking at the potential for an abduction by an outsider or stranger, Van Zandt said. Under both scenarios, he said, the odds are that the person who took Ayla knew her or her family.

Strangers' abductions of children do occur, but they're rare, accounting for only 105 to 115 children out of 750,000 to 900,000 missing-persons cases each year in the United States, Van Zandt said.

Van Zandt, who has worked similar cases, said Ayla's disappearance, which once had more than 80 searchers and law enforcement officers involved, has been difficult for law enforcers as well as for distraught family members.

"As an FBI agent working these cases, you never turn off the emotional porch light," he said. "You always leave on the light with the hope that the child will come home again."

New Earth-like planets: How did astronomers find them?

NASA's Kepler?spacecraft?has spotted a pair of rocky Earth-sized planets orbiting a distant star. How do you find a new planet??

Since 2009, NASA's Kepler spacecraft has been sitting in space, pointing its telescope at a patch of the sky near the constellations Cygnus and Lyrae. Its field of view, a region of the Milky Way galaxy about the size of two open hands raised to the cosmos, contains roughly 160,000 stars. Scientists on the Kepler team are interested not in these stars themselves, but in the planets that may orbit them.

"The goal of the Kepler mission is to find planets like Earth in the habitable zones of their parent stars," said Guillermo Torres, a member of the Kepler team based at the Harvard-Smithsonian Center for Astrophysics. They are looking for?Earth twins, because these are the likeliest candidates for worlds that could host extraterrestrial life.

To find these alien Earths, the Kepler team uses a technique called the "transit method." They scour the data collected by the Kepler telescope looking for slight drops in the intensity of light coming from any of the stars in its line of sight. About 90 percent of the time, these dips in brightness signify that a planet "has passed in front of its star, essentially?eclipsing the light," Torres told Life's Little Mysteries.

Planets the size of Earth passing in front of a star typically cause it to dim by only one-hundredth of a percent ? akin to the drop in brightness of a car's headlight when a fly crosses in front of it, the scientists say. To detect these faint and faraway eclipses, the Kepler telescope must be extremely sensitive and it must be stationed in space, away from the glare and turbulence of Earth's atmosphere.

Using the transit method, Kepler has detected 2,326 "candidate planets" so far, Torres said. Those are dips detected in starlight that are probably caused by passing planets, but for which other alternative explanations haven't yet been ruled out.? "The signals are an indication that something is crossing in front of the star and then you have to confirm it's a planet, not something else," he said. "Roughly 90 percent of the signals that Kepler detects are true planets. The other 10 percent of the cases are false positives. We're not happy with leaving the probability at 90 percent ? we've set a higher bar ? so, even though a priori we know a signal is 90-percent sure [to be a planet], we do more work."

To confirm that a candidate is a true?exoplanet?? a planet outside our solar system ? the Kepler scientists use the world's largest ground-based telescopes to study the star in question, looking for alternative explanations for the transit signal. "One example is an eclipsing binary in the background of the star. There could be two stars behind the star [of interest] that are orbiting each other and eclipsing each other, but because they're in the background they're much fainter. So their light is diluted by the brighter star," he said.

With today's (Dec. 20) announcement of?five new confirmed exoplanets?orbiting a star called Kepler-20 located 950 light-years away, including two that are Earth-size, the number of confirmed exoplanets has moved up to 33.

Did Cheetah from 1930s Tarzan flicks die? (AP)

PALM HARBOR, Fla. ? A Florida animal sanctuary says Cheetah, the chimpanzee sidekick in the Tarzan movies of the early 1930s, has died at 80. But other accounts call that claim into question.

Debbie Cobb, outreach director at the Suncoast Primate Sanctuary in Palm Harbor, said Wednesday that her grandparents acquired Cheetah around 1960 from "Tarzan" star Johnny Weissmuller and that the chimp appeared in Tarzan films between 1932 and 1934. During that period, Weissmuller made "Tarzan the Ape Man" and "Tarzan and His Mate."

But Cobb offered no documentation, saying it was destroyed in a 1995 fire.

Also, some Hollywood accounts indicate a chimpanzee by the name of Jiggs or Mr. Jiggs played Cheetah alongside Weissmuller early on and died in 1938.

In addition, an 80-year-old chimpanzee would be extraordinarily old, perhaps the oldest ever known. According to many experts and Save the Chimps, another Florida sanctuary, chimpanzees in captivity generally live to between 40 and 60, though Lion Country Safari in Loxahatchee, Fla., says it has one that is around 73.

A similar claim about another chimpanzee that supposedly played second banana to Weissmuller was debunked in 2008 in a Washington Post story.

Writer R.D. Rosen discovered that the primate, which lived in Palm Springs, Calif., was born around 1960, meaning it wasn't oldest enough to have been in the Tarzan movies of Hollywood's Golden Age that starred Olympic swimming star Weissmuller as the vine-swinging, loincloth-wearing Ape Man and Maureen O'Sullivan as Jane.

While a number of chimpanzees played the sidekick role in the Tarzan movies of the 1930s and `40s, Rosen said in an email Wednesday that this latest purported Cheetah looks like a "business-boosting impostor as well."

"I'm afraid any chimp who actually shared a soundstage with Weissmuller and O'Sullivan is long gone," Rosen said.

Cobb said Cheetah died Dec. 24 of kidney failure and was cremated.

"Unfortunately, there was a fire in `95 in which a lot of that documentation burned up," Cobb said. "I'm 51 and I've known him for 51 years. My first remembrance of him coming here was when I was actually 5, and I've known him since then, and he was a full-grown chimp then."

Film historian and Turner Classic Movies host Robert Osbourne said the Cheetah character "was one of the things people loved about the Tarzan movies because he made people laugh. He was always a regular fun part of the movies."

In his time, the Cheetah character was as popular as Rin Tin Tin or Asta, the dog from the "Thin Man" movies, Osbourne said.

"He was a major star," he said.

At the animal sanctuary, Cheetah was outgoing, loved finger painting and liked to see people laugh, Cobb said. But he could also be ill-tempered. Cobb said that when the chimp didn't like what was going on, he would fling feces and other objects.

(AP) ? Mitt Romney and Rick Perry on Wednesday assailed Republican presidential rival Ron Paul for saying the U.S. has no business bombing Iran to keep it from acquiring a nuclear weapon, drawing a sharp contrast with their rising rival as he returned to Iowa to campaign before the lead-off caucuses.

"One of the people running for president thinks it's okay for Iran to have a nuclear weapon," Romney, the former Massachusetts governor, said in this eastern Iowa city in response to a question from the audience. "I don't."

It was the first time Romney has challenged Paul directly since the Texas congressman jumped in polls. Neither Romney nor Perry, the Texas governor, named Paul, but the target was clear.

"You don't have to vote for a candidate who will allow Iran to have a nuclear weapon to wipe Israel off the face of the earth. Because America will be next," Perry said in Urbandale, reiterating a line of argument from a day earlier.

"I'm here to say: You have a choice," Perry added.

As if in rebuttal, Paul's campaign launched a new television ad describing him as "principled, incorruptible, guided by faith and principle" and the man to restore the economy. "Politicians who supported bailouts and mandates, serial hypocrites and flip floppers can't clean up the mess," it says as photos of Newt Gingrich and Romney appear on screen.

The stepped-up criticism of Paul, the libertarian-leaning Republican, comes as surveys show he's in contention to win Tuesday's caucuses.

In recent days, conservative opponents including Perry and Minnesota Rep. Michele Bachmann have increased their criticism of Paul on social issues, foreign affairs and inflammatory comments in his decades-old newsletter. By tearing him down, they hope voters will give their campaigns another, closer look after a season marked by candidates who have risen quickly in public standing only to fall back down.

Gingrich, whose slide in surveys over the past week has come as Paul has risen, said Tuesday he couldn't vote for Paul if he were to become the GOP nominee and called his views "totally outside the mainstream of every decent American" during an interview with CNN.

Gingrich, the former House speaker, began Wednesday, the second day of his Iowa bus tour with a speech to about 200 people in the atrium of the Southbridge Mall in Mason City. He plugged his support for supply-side economics favored by President Ronald Reagan.

Gingrich said the primary is giving voters a "choice between a populist supply side approach ... and a much more timid Washington-centered approach that will not create jobs."

Bachmann, who was on the 86th stop of her tour of Iowa's 99 counties, criticized both of her rivals from Texas. She accused Perry of spending "27 years as a political insider." He was a Texas legislator and agriculture commissioner before becoming governor in 2001.

Bachmann said Paul would be "dangerous as president" because of his hands-off views on national security.

Paul, for his part, was meeting with supporters near Des Moines, his first visit to the state since before the campaigns went dark for the Christmas holiday. He planned a series of events over the next two days as he looked to take advantage of a burst of momentum.

A conservative, Paul commands strong allegiance from his supporters but appears to have little potential to expand his appeal and emerge as a serious challenger for the nomination. Yet he could complicate other candidates' pathway to the nomination.

His opponents were spreading out across the state to woo potential caucus-goers, many of whom are still undecided amid a flood of television and radio ads.

In Independence, former Pennsylvania Sen. Rick Santorum mingled with 25 people at a diner and touted his plan to give a tax break to businesses that bring their operations back to the United States.

He told diners: "Things are going great, we've got momentum." He began airing a new radio ad Wednesday that promotes his hardline opposition to abortion and describes him as a "father of seven, a home-schooler and a devoted husband for 21 years."

Romney kicked off a three-day bus tour in the eastern edge of the state, in Muscatine, and shook hands with an overflow crowd at Elly's Tea and Coffee House. The line to get in stretched into the street.

Beginning the day, Romney told Fox News Channel that he was only joking Monday when he criticized Gingrich's failure to earn a spot on the Virginia ballot as something out of the sitcom "I Love Lucy."

"I hope the speaker understands that was humor, and I'm happy to tell my humorous anecdote to him face to face," Romney said.

Gingrich on Tuesday challenged Romney to make the "I Love Lucy" comparison to Gingrich's face.

Perry, looking to recapture the enthusiasm that greeted his entry into the race in August, railed against Washington and Wall Street insiders as he met with conservatives for breakfast near Des Moines.

"Why should you settle for less than an authentic conservative who will fight for your views and your values without apologies?" he asked, delivering the core rationale for his candidacy.

The packed crowd of conservatives in Urbandale applauded as he pledged to champion a constitutional amendment to balance the federal budget, secure the border within a year and crack down on illegal immigration. He also said he would bring his faith with him into the Oval Office, a nod to the Christian conservatives who have strong sway in the nominating process.

The school has regularly competed in national events to earn the praise of the Welsh Schools Football Association (WSFA).

The WSFA marked its centenary season with each of its officers donating trophies for competitions and festivals organised by the association.

John Mann, WSFA disability football officer, donated a trophy to be awarded to a school demonstrating ?outstanding commitment to disability football.?

Lugar: Paul not in GOP mainstream

Texas Rep. and presidential candidate Ron Paul is out of line with the mainstream GOP when it comes to foreign policy, Sen. Dick Lugar (R-Ind.) says.

In an interview aired Sunday on CNN's "State of the Union," host Candy Crowley asked Lugar: "Is that a Republican party message?"

?

Replied the ranking member of the Senate Foreign Relations Committee, "That's one Republican's message." And he?went on to say that Paul's left-of-Obama foreign policy views were not representative of the party.

"No, of course not. ?And it's not a message which really a president of the United States could ever afford to extend. In other words, we're a -- a party and a -- a president of leadership, leadership in the world," he said. "We have a fleet that covers all the seas, that, as a matter of fact, makes foreign trade possible, trade of all sorts. ?We're the only country that can go everywhere all over the world, and, therefore, indispensable to our allies as well as to our own interests."

"These are very, very important parts of our national strength. And they involve foreign policy. They involve armed forces and a combination of these," Lugar said.

Justice Department Clarifies Stance On Online Gaming And Poker

In a surprise move by the federal government, the U. S. Department of Justice has clarified its stance on internet gaming that could open the doors for intrastate poker to become a reality in the United States.

The legal opinion was issued by the DoJ on Friday, but the original decision was made back in September in response to a request in July by Senators Harry Reid and Jon Kyl for the DoJ to clarify its position regarding the issue of online gaming and poker. According to the New York Times two states, Illinois and New York, had also asked for clarification from the federal government regarding the Wire Act of 1961, one of the major laws used by the DoJ in pursuit of online gaming and poker.

According to the New York Times, the DoJ has reversed its stance on internet gaming and several states will take advantage of this decision to introduce new lottery games within their borders. The new position does bring the possibility into the mix that individual states or a consortium of states could band together to allow online poker to make a comeback in the United States.

The decision announced on Friday by the DoJ says the new policy ?differs from the department?s previous interpretation of the Wire Act, (but) it reflects the department?s position in Congressional testimony at the time the Wire Act was passed in 1961.? The new decision by the DoJ says that the Wire Act only focuses on sports betting and not casino or poker offerings.

Although it reverses the Justice Department?s previous stance that all forms of gambling online are illegal, it does not state that the Justice Department is looking to set regulations for a national online gaming system.

Nevada recently passed legislation that would allow for companies to offer online poker and the new ruling may allow that state to proceed forward with an intrastate online poker offering for its citizens. Earlier this month, the Nevada Gaming Control Board announced that six companies have applied for licenses, but were holding off until the federal government announced a stance. With the change in the DoJ?s opinion, the NGCB may be able to move forward with offering intrastate poker to Nevada residents.

In the District of Columbia, there is a long delayed plan to offer online poker to its residents. The latest decision by the DoJ could pave the way for that plan to actually come to fruition. Other states, such as Iowa, New Jersey, California and Florida, have also considered online poker regulation for its citizens, but previous bills have either been rejected or have been tabled due to the federal government?s opposition to internet gaming.

Whether the states will aggressively attack the new potential for internet poker will be difficult to gauge. The New York Times reports a wide varying amount that internet gaming and poker could bring in ? anywhere from $6 billion to $100 billion yearly ? and this could be the impetus behind the change in the stance by the federal government. The Times quotes Steven Grossman, the chairman of Massachusetts? Lottery Commission and the state?s treasurer, as saying, ?This will put additional pressure on (the) Congress and others to allow online poker and other internet gambling.?

There is the chance that several states could band together to make an online poker offering more attractive. Much like multi-state lotteries as the PowerBall and Mega Millions and some horse racing, a multi-state online poker offering would be more attractive to states, rather than an individual state that may lack the population to drive big revenues.

The new position by the federal law enforcement authorities comes as the momentum for regulation of the online poker industry in the United States on the federal level seemed to have faded. Although there have been hearings in the House of Representatives regarding the issue ? and Texas Representative Joe Barton has a bill for consideration ? there has been no vote on the subject.

With the change of opinion by the DoJ, perhaps such legislation can now move forward for a federal solution to online poker in 2012. If that doesn?t occur, then the states now have the right to move forward.

Cesium found in milk powder made by Japan?s Meiji ????????????

Japan?s Meiji Holdings said on Dec. 6 that radioactive cesium was found in infant milk powder made by the food and dairy firm, in the latest food scare to grip the country nearly nine months after the Fukushima nuclear disaster.

Worries over the safety of food supplies have shaken the public after the March 11 earthquake and tsunami crippled the Fukushima Daiichi plant in the worst nuclear accident in 25 years, spreading radiation over a large swathe of northern and eastern Japan.

Cases of excessive radiation in vegetables, tea, milk, seafood and water have stoked anxiety despite assurance from public officials that the levels detected are not dangerous.

Meiji said it is unsure exactly how the cesium got into the powdered milk, but it suspects radioactive substances emitted from the Fukushima accident may have been the source. A company spokesman told Reuters hot air used in the drying process may have contained cesium.

Tests by Meiji showed that up to 30.8 becquerels of cesium was found per kilogram of the powdered milk. That is below the government-set permissible limit, but the firm will nevertheless conduct a voluntary recall of the product, called ?Meiji Step.?

The limit set by Japan?s health ministry is 200 becquerels per kilogram for powdered milk, an official at the ministry?s department of food safety said.

The Rangers reportedly set a new record with their posting bid of $51.7 million, which the team will pay to Darvish's Japanese club, the Hokkaido Nippon Ham Fighters. If the reported figure is accurate, the bid for Darvish would exceed the previous record, set by the Boston Red Sox in 2006 when they paid $51.1 million to the Seibu Lions for Daisuke Matsuzaka.

Daigo Fujiwara of JapaneseBallPlayers.com noted this weekend that Darvish is one of 21 Japanese players who have used the posting system, which was set up in 1998. The posting system merely establishes the right for a US club to negotiate with a player ? contract negotiations may still fall through, and have in the past, leaving the player with their Japanese team. Of the 21 players to have used the system ? including several players like Darvish who are negotiating contracts now ? only 11 have so far successfully transferred to MLB.

Like the Red Sox's Matsuzaka, Darvish will likely draw a contract of over $50 million, putting his overall price tag for the Rangers in excess of $100 million. And the comparisons with Matsuzaka go further. Both Matsuzaka and Darvish were best-of-the-best pitchers in Japan, and key players for Japan's team in the World Baseball Classic.?

SpotiLast Builds Spotify Playlists from Your Last.fm History Discovering new music to listen to in Spotify isn't exactly difficult, but if you could use a little inspiration, Last.fm has always done a great job at suggesting new bands and musicians based on the tracks you've scrobbled from other services. SpotiLast is a new webapp that bridges the two services, and automatically generates Spotify playlists based on the suggested artists from your Last.fm account.

SpotiLast is a third-party webapp; it's not built by Spotify or Last.fm, but it does use their APIs to function. That means you'll have to connect SpotiLast to both music services for it to work. Once you've done that however, it works like a charm. The app pulls in your Last.fm suggestions, and will automatically build you a playlist, and you can click any song to fire up the Spotify desktop player and start listening.

If you scrobble those tracks back to Last.fm, you can always re-run SpotiLast to build a new playlist based on the updated suggestions, and start the process all over again. Do you still use Last.fm for music suggestions, or have you moved on? Perhaps you get enough suggestions inside Spotify. However you discover new tunes, let us know in the comments below.

Comet defies death, brushes up to sun and lives (AP)

WASHINGTON ? A small comet survived what astronomers figured would be a sure death when it danced uncomfortably close to the broiling sun.

Comet Lovejoy, which was only discovered a couple of weeks ago, was supposed to melt Thursday night when it came close to where temperatures hit several million degrees. Astronomers had tracked 2,000 other sun-grazing comets make the same suicidal trip. None had ever survived.

But astronomers watching live with NASA telescopes first saw the sun's corona wiggle as Lovejoy went close to the sun. They were then shocked when a bright spot emerged on the sun's other side. Lovejoy lived.

"I was delighted when I saw it go into the sun and I was astounded when I saw something re-emerge," said U.S. Navy solar researcher Karl Battams.

Lovejoy didn't exactly come out of its hellish adventure unscathed. Only 10 percent of the comet ? which was probably millions of tons ? survived the encounter, said W. Dean Pesnell, project scientist for NASA's Solar Dynamics Observatory, which tracked Lovejoy's death-defying plunge.

And the comet lost something pretty important: its tail.

"It looks like the tail broke off and is stuck" in the sun's magnetic field, Pesnell said.

Comets circle the sun and sometimes get too close. Lovejoy came within 75,000 miles of the sun's surface, Battams said. For a small object often described as a dirty snowball comprised of ice and dust, that brush with the sun should have been fatal.

Astronomers say it probably didn't melt completely because the comet was larger than they thought.

The frozen comet was evaporating as it made the trip toward the sun, "just like you're sweating on a hot day," Pesnell said.

"It's like an ice cube going by a barbecue grill," he said.

Pesnell said the comet, although only discovered at the end of November by an Australian observer, probably is related to a comet that came by Earth on the way to the sun in 1106.

As Comet Lovejoy makes its big circle through the solar system, it will be another 800 or 900 years before it nears the sun again, astronomers say.
