chadwick - Personal Injury Law Basics: What Is The Legal ...

Last updated 5 hours 31 minutes ago

The legal definition of personal injury is deceptively simple: If someone or something has caused you physical, emotional, or psychological damage, then it is considered to be a personal injury. But knowing the definition and properly applying it are two very different things. Here is how the definition of personal injury functions with each different type of injury:

Physical
Physical injuries are often the most obvious forms of personal injury, but that doesn?t always mean that they are easy to prove. Personal injuries that are physical can stem from a variety of sources, including slip and fall cases, car accidents, product defects, physical assault, and work-related accidents. Injuries can include everything from broken limbs to soft tissue damage to long-term disabilities.

Psychological and Emotional

Psychological and emotional personal injuries are more difficult to prove, simply because while you can submit x-rays of a broken bone, it?s much more difficult to submit conclusive evidence of a damaged psyche. Still, it?s not impossible?it simply requires a clear case with compelling evidence and psychiatric evaluations to back it up.

One example might be of a person who has a psychologically and verbally combative manager at work. Gradually, the employee begins to sink into depression and fear. Even after she quits her job, she may experience Post-Traumatic Stress Disorder (PTSD). If she can obtain a psychiatric evaluation attesting to her mental illness and its probable causes, document what her boss did to her, and show that her company did not take appropriate measures to protect her, then she will likely have a solid personal injury case based upon injuries that are psychological in nature. However, she will still need a good personal injury attorney to make the case work.
